Teacher’s help sought, student says

A student who has accused a Pine Creek High School teacher of sexually assaulting
her told investigators the incident occurred after she asked for help to improve her
grades.

The student got an A in the chemistry class despite failing the final exam, according
to an arrest affidavit.

The teacher, Derrick Adam Davies, 30, appeared in court Wednesday to be advised of
his rights. Colorado Springs police have recommended he be charged with sexual
assault on a child by one in a position of trust.

El Paso County Court Judge Stephen Sletta ordered that Davies’ bond be doubled,
from $5,000 to $10,000. Davies remained jailed Wednesday night at the El Paso
County Criminal Justice Center.

Academy School District 20 spokeswoman Nanette Anderson said Davies has been
suspended, officials are watching the court proceedings and he won’t return to Pine
Creek this fall.

According to the arrest affidavit, the incident in March bothered the student, who
mentioned it to her priest. She then told her parents, who called police July 27.

The student was in Davies’ chemistry class and told investigators “he was her
favorite teacher” and she often would visit him before and after school and during
lunch breaks.

When her grades started slipping, she asked Davies what she could do to earn extra
credit. He suggested she do a research paper and study harder. Davies then allegedly
asked her what she would think if he “played around with her,” the affidavit states.

The student thought he was joking, but Davies allegedly locked the classroom door,
turned out the lights and took her to a back corner of the room, the affidavit said.

She told investigators he put his hand down her pants and assaulted her for “about
five minutes.”

In the days that followed, Davies asked the girl not to tell anyone about the alleged
incident “because he could lose his job,” according to the affidavit.

While the girl continued to go to class, she didn’t turn in many assignments and
scored only a 47 percent on her final exam. She still got an A in chemistry, according
to police.

When investigators confronted Davies, he admitted to the one incident and told them
of another the student didn’t mention. Police arrested him Tuesday. Other than a
traffic ticket, Davies has no criminal record in Colorado.

If convicted, Davies could get six years in prison and a $500,000 fine. He is
scheduled to appear in court again Monday.
